Why the Answer Deadline Is Absolute
In ordinary civil litigation, defendants frequently have 20 to 30 days to respond. However, residential eviction actions—commonly called summary proceedings or unlawful detainers—are accelerated proceedings governed by expedited court rules. If you miss your Answer deadline by even a single hour, the landlord's attorney can submit a request for an immediate Clerk's Default Judgment for Possession.
What Happens Upon Default?
Once a default is entered, you lose the right to present your defenses or contest the eviction. The court clerk immediately issues a Writ of Possession (or Writ of Restitution) directed to the county sheriff or marshal, who will post a final 24-hour to 5-day Notice to Vacate on your front door before executing a physical lockout.
