Ohio evictions are bifurcated into two separate "causes of action": the First Cause (restitution of the premises) and the Second Cause (money damages for unpaid rent).

Bifurcated Procedure & Rent Escrow

The hearing on the First Cause typically takes place within 7 to 14 days of service. To assert habitability defenses under R.C. 5321.07, tenants must demonstrate that they gave the landlord 30 days written notice to correct defects and deposited rent into the court's municipal escrow account.
