Pennsylvania Landlord-Tenant Eviction: MDJ Hearings & Appeals

The Landlord and Tenant Act of 1951 (68 P.S. § 250.501)

In Pennsylvania (outside Philadelphia), eviction cases begin before a Magisterial District Judge (MDJ). The MDJ sets a summary hearing within 7 to 10 days of service.

The 10-Day Appeal & Supersedeas Rule

If the MDJ rules for the landlord, the tenant has strictly 10 calendar days to appeal to the County Court of Common Pleas. By filing a Notice of Appeal and obtaining a supersedeas (filing an in forma pauperis affidavit or paying 1/3 of monthly rent), the lockout is automatically frozen.
